Resale Royalty Scheme: Information for Art Dealers, Auction Houses & Galleries
The government has engaged Copyright Agency Ltd (CAL) to manage the artists’ resale royalty scheme. The scheme provides artists with a 5% royalty on certain commercial resales of $1,000 or more that occur after 8 June 2010. The royalty applies to existing as well as new works, but will not apply to the first change of ownership after 8 June, even if that is a resale.
From 9 June, sellers, buyers and art market professionals (such as auction houses, commercial galleries and art dealers) will need to provide information to CAL about all commercial resales, including those that do not generate a royalty. CAL has launched a resale royalty website (www.resaleroyalty.org.au) that include facilities to provide information about resales using online forms and/or by uploading files such as spreadsheets.

What has CAL been doing to help you prepare for the scheme’s commencement?
- We have set up an art trade advisory panel, to advise us of matters relating to business systems and practices in the art trade relevant to the resale royalty scheme
- We have met with a number of auction houses, commercial galleries and their representative organisations
- We have contacted many others in the art trade by phone and email, and continue to liaise with the art community on an ongoing basis
- We have disseminated information to members of the Australian Commercial Galleries Association at chapter meetings
- We have upload an information sheet for buyers and sellers to this webpage
